Terms of Service

These Terms of Service (“Terms”) govern your use of swingtilt.com (the “Site”), our customer portal, and any windows, doors, or related services provided by Greenbuild Homes LLC, doing business as SwingTilt Windows & Doors (“SwingTilt,” “we,” “us,” “our”). By using the Site or placing an order with us, you agree to these Terms. If you do not agree, do not use the Site or order from us.

1. Eligibility

You must be at least 18 years old and able to enter a binding contract to use our services or place an order.

2. Quotes & Orders

• Custom quotes. Every project is custom; any pricing shown in our online design tool is an estimate for planning purposes only. Final pricing, specifications, lead times, and delivery dates are confirmed in writing by SwingTilt before an order is binding.
• Made-to-order. Our windows and doors are built to your exact opening and configuration. Once we have authorized production with the manufacturer, your order is non-cancellable and non-refundable except as provided by applicable law or as expressly stated in your written quote.
• Lead times. Typical production and delivery lead time is approximately 12 weeks from order approval, but actual lead times vary by product, configuration, season, and shipping conditions and are not guaranteed.
• Acceptance.An order is binding when you sign or otherwise accept SwingTilt's written quote and we receive the required deposit.

3. Payment

We do not process online checkouts. Accepted payment methods are stated on your written quote and typically include wire transfer, check, or Zelle. Deposits required to place an order are non-refundable once production has begun. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate allowed by law, and you agree to pay reasonable collection costs.

4. Installation

SwingTilt sells and ships products only. Installation, if needed, is performed by independent, licensed local contractors selected by you or referred at your request. Independent installers contract and bill you directly, set their own pricing and schedule, and are solely responsible for the quality, safety, and warranty of their installation work. SwingTilt is not the employer, partner, agent, or guarantor of any installer, and is not responsible or liable for installer workmanship, damage, delays, or contractual disputes.

5. Warranty

Our products carry a 25-year limited manufacturer warrantycovering profile, hardware, and sealed glass unit performance under normal residential use, subject to the manufacturer's published warranty terms and exclusions that accompany your order. The warranty does notcover damage caused by improper installation, accident, abuse, alteration, improper maintenance, acts of nature, or normal wear of finishes. To make a warranty claim, contact us at hello@swingtilt.com with your order number and a description of the issue.

Installation work is not covered by the SwingTilt product warranty.Installation warranties, if any, are provided by the independent installer who performed the work.

EXCEPT AS EXPRESSLY STATED, SWINGTILT DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.

6. Customer Portal & Accounts

You are responsible for maintaining the confidentiality of your customer-portal login and for activity under your account. Notify us immediately at hello@swingtilt.com if you believe your account has been compromised. You agree not to share your credentials, interfere with the Site, attempt to access another customer's data, or use the Site for unlawful purposes.

7. Communications Consent

By providing your contact information, you consent to receive communications from SwingTilt about your quotes, orders, and account by email, phone, and text message. See our Privacy Policy for details on SMS messaging, frequency, opt-out instructions, and how we handle your information.

8. Intellectual Property

The Site, including its design, text, graphics, logos, the SwingTilt name and mark, the customer portal, and the online design tool, are owned by SwingTilt or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Site without our prior written consent, except that you may use the design tool and your saved designs for your own personal, non-commercial purposes related to a project you intend to purchase from us.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SWINGTILT AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SWINGTILT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TO SWINGTILT FOR THE PRODUCTS AT ISSUE.

10. Indemnification

You agree to indemnify and hold harmless SwingTilt and its owners, officers, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your installation or use of products contrary to manufacturer instructions or applicable law.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. The exclusive venue for any dispute arising out of or relating to these Terms or your order is the state or federal courts located in Greene County, Missouri, and you consent to personal jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent change. Material changes will be communicated by posting on the Site or by other reasonable means. Continued use after changes means you accept the updated Terms.
